License, Copyright and Terms of use

Please read the following sections carefully. By installing the software, you declare your explicit agreement to be bound by the terms of the license agreement. If you do not agree to the following terms, you may not use the software.

Copyright

The program is subject to national and international copyright protection.

All rights resulting from the copyright are reserved to the NEXT Farming Sales GmbH

(hereinafter referred to as licensor). The copyright includes in particular the program code, the documentation, the appearance, the structure and organization of the program files, the program names, logos and other forms of representation within the Software.

The user of the Software (hereinafter referred to as the Licensee) is granted only the individual, private right of use of the Software.

An acquisition of rights to the software itself is not associated with this. The Licensor reserves all rights to publish, reproduce, process and exploit the Software.

Scope of use

The licenser grants you as licensee the simple, non-exclusive and personal right to use the software exclusively for private use on a single computer system and only at one location.

The commercial use of the software requires a separate agreement with the licenser.

You as licensee are entitled in detail:

To make a copy of the Software for archiving purposes or to copy the Software to the hard disk of your computer and archive the original data carriers.
Use the Software on a network, provided that you have a licensed copy for each computer that can access the Software via the network.

Special restrictions

In particular, the licensee is prohibited from doing so:

to make copies of the software, in whole or in part, on other data carriers beyond the scope mentioned in the section "Scope of Use" (see chapter "Scope of Use:").
To rent or lend the software, in whole or in part, or to grant sublicenses.
To transfer the software permanently or for a remaining license period to a third party.
To reverse engineer, decompile, disassemble or otherwise attempt to make available the source code of the software, to modify or translate the software or to create derived products from it.
Reproduce, translate or modify the written material and create derivative works based on the written material.
To continue to use the software after the expiry of the limited user license.
Unlawfully extend the term of the limited user license by taking appropriate measures on the hardware or by manipulating the operating system or software.

Irrespective of whether any of the remedies set forth herein fail to achieve their essential purpose, in no event shall the manufacturer of the software or its suppliers be liable for any indirect, consequential or similar damages (including damages for loss of profit or loss of data) arising out of the use of or inability to use the software, even if the manufacturer of the software has been advised of the possibility of such damages.

The Licensee is expressly advised that he/she must regularly make backup copies of the data on his/her computer at sufficient intervals (usually weekly). Furthermore, he shall not delete any file from the database directory without prior backup. If he does not do this, he is in breach of his obligation to minimize damages. The Licensor is not liable for any damages resulting from these violations.

All technical information and programs in this book have been developed or compiled by the authors with the greatest care and reproduced using effective control measures. Nevertheless, errors cannot be completely excluded.

Right to use the database

The database machine (Advantage Database Server) supplied with this program may only be used and operated with this system and the associated components. If you also want to use this database system for other programs, you need a separate license for the database machine

Right of use of the program system

NEXT Farming Office

The applications from the program system are licensed via corresponding activation numbers. This license cannot be transferred to other computers. If you need to use the software on additional PCs, a follow-up license is required for a fee. A local sales partner will be happy to advise you on this.
